Settling on commercial terms doesn't necessarily mean a bad outcome. Without knowing the quantum of the settlement it is impossible to know if it was a nil-all draw or something worthy of pursuing. Perhaps the reason for pursuing it was so that those who were wronged felt that somebody actually had their back - i.e the current management were being good corporate citizens. Even if we have walked out of this no worse off cash wise - is that such a bad thing?
