Looking at the judgement by the HCA, I presume that from a costs perspective , the judgement by HCA is bad news for shareholders of NHC. NHC lost its cost order in the QCA and in the HCA , NHC must pay its own costs plus those of OCCA. I wonder how a firm of lawyers that act pro bono can claim back their fees that were not changed? Finally, how will the newly (yet to be convened) Land Court deal with New Acland's application , in light of the comments by Their Honours? ( See paragraph 101 for instance) I don't have confidence that NHC will get approval from a newly convened Land Court.
