It is my understanding that t he Queensland court of appeal awarded costs against the Appellant (occa). The High Court of Australia has reversed that order.
again based on articles in Facebook, I understood that EDO was acting pro bono. Also in the initial HCA hearing OCCA advised the two judges that they were broke.
despite occa pecuniary state the full hearing went ahead.
the present outcome is bad news for NHC. They lost their cost order in QCA and have to pay OCCA costs in HCA. Finally its back to square one. I recall the first Land Court hearing went for 100 days!!!.
I can only presume that OCCA will be fully funded by the Environmental Lobby including various State Governments.
