You are right, in 3 years time another non associated party could get the approval.
For that to happen though
- current application refused
- New Application Refused (say 12 months)
- There is a 2 month grace period where the expiry is extended allowing the operator to submit a new application - another 12 - 18 months
So for that to happen the government would have to reject 3 subsequent applications to then go and approve another operator.
