Yes that is right. The offence he is charged with must be punishable by a year in gaol and he must be convicted of that offence. Once convicted (doesn't matter what the sentence is, that is irrelevant), he would be out of parliament and yes a bye-election, at the least, would have to be called as that seat would be vacant as at the time of the conviction. I would has a guess if thing got that out of hand the GG would have to dissolve the parliament (?)
