    It's not MK that's playing though - it's in the court approved agreement - no Commonwealth decision until NSW make theirs. The quickest way to get your new decision overturned is to ignore the court's previous order.

    But yes - agree - the question is when does NSW make their decision. I think they realise that MK will approve, because they want their bill (not Zali's) to go through to try and prevent 'onshore development' for petroleum recovery (aka pipelines).

    However - this is where the constitutional law gets complex - because by doing so (banning pipelines to commonwealth waters) it could be argued that they're preventing commonwealth sanctioned projects - and therefore it is an unlawful restriction because they're hindering a project ultimately that the commonwealth has approved. So this legislation they're trying to pass isn't a done deal re banning pipelines by any stretch.
