Ive just had a chance to read the article.

    Very interesting!

Apprehended bias was applied to this court decision by the Federal Court Judge in South Australia because it was publicly supported by Minister for Resources Keith Pitt. The Kimbra Nuclear Waste Dump project definitely has some similarities to PEP11

Madeleine King and Anthony Albenese have bith previously stated their opinion on PEP11 which could definitely indicate apprehended bias towards a decision.

I wonder if it could be argued that the department (DISR) and government was infected with apprehended bias which would indicate a predetermined outcome for PEP11 if not approved by the Minister for Resources.

Lets just say NOPTA recommended approval and the Minister or Delegate refuses. This would be a interesting argument.

Anyway I just have one question...
Why didn't Scott Morrison make a decision on the Kimbra Nuclear Waste Project when he was the self appointed Resources Minister?
