I think we all assumed NSW makes the decision first, then advises the Commonwealth JA of the decision.

The description below indicates the process is a little more circuitous in that the Commonwealth make the decision first, then send it to the State for consideration. The State advises whether it agrees or not. If the State approves, it advises NOPTA. If the State refuses ,it goes through a procedural fairness process from which information is shared across all parts of the JA for consideration. The State then refers this to the Commonwealth at which point the Commonwealth can chose to agree or disagree with the State and can override if necessary.
