Apprehended bias under the law is either direct bias or what can be 'seen' to be bias.
It wouldn't be that hard to prove that having a boss (Albo) and another boss (King) saying PEP11 will not proceed creates the notion that the party has a bias or can be seen to have a bias when applying their decision making powers to PEP11.
That's why IMO approval is the only option as hard a pill as that will be for them to swallow and they are setting up the political insulation for this to occur....enter Husic.
