The problem if madeline king had ultimate say, is nopta is in her portfolio.

If nopta says yes and she says no, she would be ignoring her own departments advise that ultimately reports to her.

That would be an issue if in court with bph.

If she says yes, the reverse, may not be using independant discretion and being influenced by a department that reports to her.

That would apply if legal from a climat group.

I would think legal action would occur if yes or no.

Having Mr Husic determine, is independant of nopta's recommendation.

So I think minister King moving the decision to Mr husic is not for political insulation.

His answer if legal, in retrospect to nopta.

"they do not report to me, they report to minister King"

I think a decision is very close now.
