I dont think so. just because NSW has legislated the 5km Ban Bill does not give them an OUT from making the JA Decision in accordance with the Law. In the recent past (from what I am aware) NSW REJECTED PEP11 with HIGH LEVEL of BIAS!. This time (in Jamie Tripodis words) they are reassessing the Application and are making progress!
Sooo... NSW can legislate all they like - but they can not legislate out of NOPTA..... and they need to make their decision in accordance with the LAW... which I believe in this instance - should be an Approval.
Ed... he can put the pressure on NSW....ultimately it is the FEDs who have the responsibility of PEP11.....
