The legislation states the minister makes the decision, nobody else.

The judiciary can review it, but not jump in and make a ministers decision.

At the moment there is a review of laws concerning time, as it's not just fossil fuels, but wind farms and solar that have multi year delays.

So if in court on time, the government argues the legislation and we are planning to amend it.

I do not think the Courts would event issue a writ to start litigation if based on time to get there.

Its just a shame Australia is entrapped in procedural red tape on basically everything gov related.
