That's an interesting supposition, however doesn't the problem go back to the fact that the act does not have prescribed times that need to be adhered to and as such everyone can be seen to be following process at the moment albeit its slower than treacle.
The only time mechanism as I read it is the Fed JA's ability to request the state JA provide a decision within 30 days of asking and at this stage that seems very unlikely.
