If we look at changes in land mass, seas.

Australia was connected to png and Indonesia. In the South, Victoria was connected to tasmania.

So possible water claims top of qld, nt, top of wa and between Victoria and tasmania.

Australia was not connected to nz off nsw, the east of Australia.

Migration paths of first nations people were Indonesia, png down.

This is why very unlikely a native title claim off nsw and around pep11 permit.

The legislation is simply covering all bases, wether potential claim or not can arise, which I doubt as mentioned above at pep11 in regard to migration paths.
