no section 64 of the constitution is clear that the prime minister can appoint anyone including himself to any ministry even if it already filled.
he advises the Governor general and the GG appoints him.
the problem is there is no accountability to the public or parliament if the appointment is secret. It is a loophole which the current government was going to address but of course they haven’t/. No politician will close a loophole they themeselves might need at a later date.
