Not upto dB specifically. All permit applications need to be dealt with by the government.
No legal reasons for a decline, yes the government is trying by passing nsw law and the attempted private members Bill at federal parliament.
But no legislation changes can be pre dated to before the pep application.
That I am sure his honour will determine if this ever lands back in court.
Delaying will just make the process painfull for a defence when his honour wants to know why.
Politics will not be a defence.
DB announces to the market all material facts he is lawfully bound to release.
