There is a risk that the application will not be successful and in these
circumstances the Company will need to consider its next steps in respect
of PEP11 or any further action it could take to preserve the permit.

Further, as noted in Section 6.3 above, Onshore Energy made an
application for suspension and extension of the permit conditions in EP386
which was not accepted by DMIRS and subsequently lodged an appeal
against the DMIRS decision with the SAT. The SAT determined that it did
not have coverage to hear the appeal and the decision allowed for the
matter to be determined through a Supreme Court of WA action.
