Yes and as they appear to be on the ropes the Gov due to their inept handling of everything since they took office, they will NOT want the added media coverage of an extended litigation event.
The smart play here (and we know there are not many in Gov whom are) is to just rip off the PEP11 bandaid and just do their job and provide a recommendation back to NOPTA.
