    So lets look at the facts as they stand and as we know them to be:

    1.NOPTA has approved the application
    2.100% of other permits have been approved in accordance with NOPTA recommendations
    3.Scomo made a decision to deny within 8 days
    4.JA have had this application for over 9 months after a court ruling over a year ago
    5.The presiding judge instructed the Government to follow the law
    6.The Government has employed delaying tactics with this permit and has singled it out to the point of introducing legislation to prohibit its production
    7.The Government must follow Model Litigant policy
    8.The FOI's contain much information that the Government does not want to release to the public

    I can only imagine that as all parties do when they are involved in dodgy practices, the Government is now scrambling to try and come up with something that seems half reasonable as a defence to all these matters above.

    My opinion is if there was such a defence this permit would have been denied when Scomo had the chance.
