i shall defer to those better versed in such Court Actions
My simple view is the Gov knowing there's no way out want there hand forced. It's about optics imho.
They can't appear to actually back the project. They'll spin endlessly to still appear to be standing their ground, upholding their ire, flying the flag as it were..
