IMO
DB and his lawyers would have had that comment/date as the basis of their year(s) long strategy IMO. That was the only trigger they could point to as being UNJUST delay. Remember... JA has past form in delaying a decision. BUT NO ONE ESLE has taken them to Judicial Review that I know of - for delaying a decision - and Asset has the ability to do so cos - IMO - the delay is a result from a previous judicial review (ie Bias Consent Order)
