That is why (for me anyway) we need to know what are EDs concerns??? how REAL are they??? the OPGGS Act says finance/public interest etc are reasons for refusal - (it does not give anything NEW for ED to pull out of thin air).. they have already been assessed by NOPTA before - and NOPTA has recommended approval - like they probably have done with hundreds of other applications!!
So if they want to REFUSE - go for it.... we will have their own dept (ie NOPTA) on our 'side' (ie their report/recommendation) but also - IMO - past precedents of OTHER APPROVALS.
Compensation is a clause of the OPGGS Act... and i would even say should be accessible under common law - should they want the title back!
