Where did I ever say it is a certainty? All I asked Lloyd for was a reason for his belief that it would definitely be declined, he eventually provided it "Politics". People can make their own mind up as to whether that is what will happen, I don't subscribe to that theory, simple.
As for the rest of what you posted, the Government did not defend the allegation of apprehended bias. Read the Judgement, the Judge supported the allegation, and therefore found the decision illegal, quashed the decision, and directed it to be done properly. So, if you, or anyone else, has any views on what the JA may have concerns with this time, please feel free to share.
