it's a great question. the only thing that keeps coming back into my mind is what agreement was reached between BPH and the Government in the courts. To my knowledge has never been made public. If you think about what happened and BPH taking the Government to court, being in a position (my opinion) where would have been ruled in favour of BPH, only to reach an agreement and not go to court. then what?? it's all about timing.

Have spoken to many people all who have advised due process was previously approved, permits, enviro plans, NOPTA whatever and KP was ready to push the button. so taking that into consideration, and having been re-reviewed, there's no reason why it shouldn't be approved as it essentially previously was (permit). what do they say about ducks??? I would assume there would be a lot of late night sessions between state and federal with federal trying to slap the state in line in order to comply with whatever agreement was reached. speculative.
