Incorrect. The metaphor of the fruit from the poisonous tree is similar to that scenario.

There are two problems there, 1) the Federal court actually doesn't check the merits of the NOPTA decision anyway, (not their jurisdiction). 2) Using your logic, the same can be said for the defense, if they thought the reasons for rejection were invalid... (why didn't they put that forward as an argument? lol).

They Both (ALL three parties) agreed to submit an Agreement - a Consent Order by the Courts.
