In one hand hold the sword of litigation. Being what you might ask ? .... to implore the courts to instruct the Gov to a timely decision which is their requirement, otherwise it unfairly restricts and impedes.
On the other hand he needs to hold the Shield, that being the warning of MASSIVE compensation should the Gov deny natural and lawful process.
