I should also add that I am not a believer in the "SP weakness on refusal theory". To me, the sooner either decision is made, the better. If it is refusal, as foreshadowed by Husic on 18th September 2024, great, let's get the Federal court action started.

When Husic released his preliminary view, BPH dipped, so IMO refusal is already priced in. MMR is currently trading at a signnificant discount to BPH, so further weakness is highly improbable IMO. Anyone banking on (a) refusal, and (b) expecting existing SH to sell down on refusal because they are "surprised" is backing a flawed strategy IMO. If anything, a formal refusal will be a buy catalyst as the timeframe to decision will be clearer and nearer.
