I was talking about that very strategy to someone just a little while ago.

Look its not out of the realms of possibility (although I reckon unlikely)

But lets play devils advocate for a sec JC.

1. The strategy all along was to delay until the election
2. They got to the election
3. They have been advised by the AG that under the model litigant process they do not have a case to defend
4. They do not lodge their bundle and lawyers get to work sorting out the outcomes
5. The election comes and goes and ALP are either returned so PEP11 doesn't matter or they are ousted so PEP11 doesn't matter

It's an interesting scenario
