Most of it good logical rational arguement.
So let's continue the rational logical reasoning.

The other investors, the governmenment, the ATO, your financial advisonr and you all thought the MIS was OK

But you are suggesting, despite all the other endorsements and you and the other investors thinking it was ok, BEN should have known it was not OK.
And therefore it is somehow BENs fault and you don't have to pay back the loan.??????????????
That is NOT logical !

I know we have been through all this before, but BANKS do not endorse or validate their clients investments.
Banks do not share in the profits from successful investments by their clients, nor do they share the loss when clients investments are unsuccesful.
Banks are in the business of lending money to clients to invest.
It is the clients responsibilty to invest the loan money they initially receieve wisely,
and to pay back the initial loan.
In this case, those that invested in the Gt Southern schemes made a bad choise.
Yes, there is someone to blame, but it is not BEN.

Tomorrow, Feb 22, the court proceedings start again.
This will be the 4th attempt.
On the first 2 occasions, the JUDGE rejected M&Ks admissions, and the 3rd time M&K failed to adhere to the court time-table for lodging documents. So the BEN solicitors asked for the brief adjournment to view what was being lodged.
Despite what some posters have implied on these threads, BEN has not sought to avoid or delay these proceedings.
The delays have been brought about by the shortcomings of others.
