Going from Eshmun's post a while back I don't think that it can be settled now that the case has been heard, i.e. the court will rule which will bind the parties, although it may be possible to appeal. It has been a good long while now since it was heard, certainly require some patience with the courts. I do wonder though whether nst selling is any indication of what they think the likely outcome will be (i.e. not in their favour), but that is just speculation.
