I accept what you and McLeod have said on this matter. I do however find it strange that if these matters were so well known, why then did Doctor Cowie fail to put this up in D &D as a possible reason for the on-going delays to getting a BFS / JV with X-strata ?

My recollections ( and I stand to be corrected ) were that he kept on suggesting that X-strata were just playing hardball in trying to get Nkwe to offer the best possible cost stucture on the proposed BFS ... nothing about them being nervous regarding legal issues.

Regardless, what you and Macleod have said does ring true if X-strata did indeed know what was going on legally.
