Nonsense. Negligence is exactly what insurance is for. The property insurer (BHP probably self insured at these levels via a captive) will pay the claim. They will then go after the insurers of the designer, builder, and/or inspector. All things being equal negligence will not void the cover unless it was wilful (i.e. deliberate and not accidental).
Saying that I agree with the rest of your post. Lots of uncertainty. Not good for a company share price.
