I can understand to a degree however the commercial implications of an ASIC probe - it could make small-cap stocks tank big time if they were to be seen to be investigating, which could be disasterous for a company that had not actually done anything wrong - especially when many in this mold live and die by placements to keep things going.

There would be a lot of very angry shareholders if ASIC screwed up on a public investigation of a legitimate company that saw their holdings become worth a fraction of what they are.

An untouchables group could lead to abuse of power.

Compared to the current scenario however, where shareholders can be lied to in ASX announcements, through email and in person - with no obvious recriminations against the perpetrator - it would be a big step up.
