On 2 February 2017 MEC Resources Ltd (Company) issued a writ of summons in the Supreme Court of Western Australia against Trandcorp Pty Ltd (“Trandcorp”) and David Leslie Breeze.
The writ has been issued as the Company is still not in full possession of all Company property and data under the control of Trandcorp and Mr Breeze despite contractual obligations requiring the return of this material following the termination of Trandcorp’s engagement as consultant and the cessation of Mr Breeze’s appointment as Managing Director of the Company in late November 2016.
The writ claims amongst other things orders for the return of Company property and data, damages for breach of the consultancy agreement, compensation pursuant to s1317HA of the Corporations Act 2001 (Cth) (“CA”) for conduct in contravention of s183 of the CA, interest on damages and/or compensation as assessed, and costs.
