I agree that this case must only help CHM cause.
Spiderman the constructive trust is an election of the form of damages or compensation being pursued. It is not a type of case.
In the one shown the plaintif has being given a choice while CHM have already stated what it wants which is shares in Crosland.
This case again is about directors misusing their position.
It is not apples and oranges but sends a clear warning that if you are in a position such as Grimaldi and Barnes you mustnt use it for personal gain.
