On the surface you're correct.
However if you read the defence document you'll get a better view of how the barrister reached that conclusion......and what information was not presented to him prior to making it.
It makes fascinating reading.
I can now see why WTG went to such pains in its preparation as well as highlighting in the RNS how interested parties could access it via the courts. Do take a coffee first....my little brain struggled to keep up.
