fascinating too that they see fit to mention 'without prejudice' the warranty cap limit of 100m pounds in the final point of the defense summary. what is the point of that i wonder. perhaps everybody is exhausted enough already and they are preparing to concede the warranty claim in the absence of a misrepresentation claim (from what we know, that was the independent barrister's assessment as to likely outcome if litigated so who knows, maybe they all might decide to just pull up stumps soon instead)
