Errr why did you link to the ‘exempt devices’ section?

RHY would have to take the regulator to court. Just like someone would have to take the ATO to court for breaching statutory time limits on an audit (which can be two years)

it’s done as a civil action tort for ‘breach of statutory duty’ and that’s how it is usually done when any government agency/ regulator has breached any statutory provisions contained in an act.

Anyway I don’t think we need to turn this into some public law discussion on ‘who enforces the regulators’
