They are obviously very confident. I am not a lawyer yet alone an american one . It is my understanding that when a government department prosecutes in a case like this they can be looking for either one of or both of the following
1. An interpretation of the law to set policy in the future 2. enforcement of the interpretation the government department is correct
We should know by tomorrow unless as they often do one or other party applies for and gets a delay
