Good question - I was wondering the same thing.

My off the cuff is that a conditional agreement - especially in light of TPT been unable or unwilling to advance the loan-would not trigger it. I put in a call to one of the board today to check and he said they would look at it.

I think the practical problem however is that even it does not trigger the pres occurrence JKA will need to draw down the funds fairly soon making this issue academic . The deal is dusted - we are really just waiting for the new plan.
