Hi Patentguy, so what happens if another mob were to come up, unknowingingly, with a capsule design that was the same as Yowie's new one in the following scenarios:
1) the new company start selling chocs with toys using their new capsule, which just happens to be effectively the same as Yowie's new one
2) the new company submit a patent application for their new capsule, not knowing about Yowie's patent possibly even because despite their searches nothing come up so they think their design is unique?
