Having had a quick look at the choco treasures patent, it sounds very similar to Hank's patent (although it is hard to understand, a picture would have been nice). If they can get that through without it being deemed to infringe Hank's patent then the purported Yowie design, which has previously been discussed, would seem to have no problem, in my opinion.

And as far as the ball being in Hank's court IP wise and Yowie having no cards to play, I guess the biggest card is that if anyone wants to use Hank's IP they have to deal with Hank - Yowie was the only company which took up that option in 10 years, I guess we will see if companies now are more enthusiastic.
