    Dead mouse ‘in packet of SpongeBob biscuits from The Reject Shop’

    A DEAD mouse allegedly found in a SpongeBob SquarePants biscuit packet opened by a young girl has left her and her mum so traumatised they are suing for damages.

    Ozlem Yaman, 42, of Caroline Springs, claims she watched in shock as she witnessed her then 10-year-old daughter Azara open the packet containing the dead animal after buying the 10-pack of SpongeBob SquarePants Mr Munchies cookies from The Reject Shop at Caroline Springs Square in February, 2015.
    Azara, now 12, and her mum are both suing the Reject Shop; Hot Shots (Aust) which supplied the cookies; and their Chinese manufacturers, Guangzhou Galaxy Food Products and Galaxy Food.
    Both claim they suffered nervous shock at the time.
    According to separate writs lodged with the County Court, the experience also causedg Azara and her mother to suffer ongoing psychiatric injury of anxiety and depression, post traumatic stress disorder and anxiety disorder, with phobic features in Azara’s case.

    Ms Yaman also claims to have suffered panic disorder with acrophobia _ an extreme or irrational fear of heights.
    As a result of her alleged injuries Ms Yaman claims she has lost yet to be detailed income and future earning capacity.
    Slater and Gordon lawyer Alvin Achariya said Azra has started screaming when the packet was opened at home.

    Mr Achariya said the next morning Ms Yaman and other family members visited the store with the bag of cookies.
    “The staff at the Reject Shop laughed and said there was nothing they could do about it,” she alleged.
    “She is affected psychologically and has been diagnosed as suffering from an anxiety disorder with phobic features and associated depressive feelings.”
    Their claim says that by accepting payment for the cookies The Reject Shop entered an agreement that the items would be fit for human consumption and of saleable and acceptable quality.

    The mother and daughter allege the store was negligent because it sold cookies that were not safe to eat; failed to carry out sufficient testing or inspection or to have sufficient quality control to ensure they were safe for human consumption; possibly allowing the cookies to become contaminated; failing to remove them from sale and exposing them to the risk of injury.
    The pair further claim the supplier and manufacturers may have made contaminated cookies that were unsafe through also failing to undertake adequate testing, inspection and quality control to ensure the remains of the mouse were not packaged with the cookie present and supplied them for sale in breach of Australian consumer laws.
    They are each seeking unspecified damages.
    The Reject Shop CEO Ross Sudano, said the product was no longer stocked and an enquiry had been launched into the incident.
    “We take our responsibilities as a retailer extremely seriously and have rigorous processes and policies in place to ensure our products meet the expectations of our customers,” he said.
    “In addition to launching a thorough enquiry we have written to both the importer of this product and the manufacturer seeking a detailed explanation of their processes.”
    Mr Sudano urged any customers with concerns to contact the retailer but said he believed it to be an “isolated example” and was not aware of any other complaints.
