Surely COP would be compelled to participate in arbitration? I don't know, but I would have thought a refusal would default to a victory for the opposition. If not, then the whole notion of arbitration is nonsensical, leaving a lawsuit as the only available mechanism.
You're right about one thing, Buffalo: The issues involved in this PE are extremely complex. Extremely. Whilst we in the Pom Pom Brigade are inclined to believe - hope? - FAR is a clearly wronged party, let's not lose sight of the fact that the alleged wrongdoers employ incredibly clever lawyers and lobbyists and will be throwing the kitchen sink at us. Victory is by no means assured.
