    I don't know the detail of this particular contract, but if the contract was found to be invalid, nothing in the contract would be enforceable, including compensation.

    Alternatively if a contract can't proceed due to outside forces, it is possible there isn't the same penalties as you would find in a termination clause.

    So the advice from the QC and Judge could be reliant on the Moreland and Yarra Council's legal action and not the State governments.

    The additional guarantee by Treasury looks to be the thing that will ensure compensation is paid.

    The whole thing stinks.
