Section 125(2) of the corporations law allows restrictions to be made under a company's constitution which can restrict its powers and its objects (activities) under certain circumstances.
If a company has restrictions on its objects (activities) under its constitution there may be limits to what it can or can not do.
Without seeing MLX's constitution it is impossible to know if its objects contain any restrictions which could cause an issue in this instance.
I've just asked the question hoping to get a more informed answer. But on this forum that's unlikely to occur.
