A company must pass the 50% continuity of ownership test or if that is failed it must pass the continuity of business test. The continuity of business test (previously the same business test) was relaxed for losses incurred after 1/7/15 such that carrying on a similar business will satisfy the test. I would expect ADN would pass the continuity of business test (and for losses pre 1/7/15 the same business test) even if it doesn’t pass the continuity of ownership test.
