Among the great reports from the coal face by HC posters, I recall reading that MZN side threatened they would be back..meaning in my mind they were not expecting a positive outcome and were all ready planning an....appeal.
lets say, if the Judge was beginning to form judgement and was leaning in favour of KDR on well established legal grounds, do you have the arrogance to poke the bear in the eye? Nice one !! and then expect the bear to reward you!
If my interpretation has any merit, I can't see the Judge rewarding MZN by being easy on allocation of costs, I would only imagine this could be the opportunity to send a very clear message of disdain.
