I hear what you are saying about the U.S. medical system. Its a shambles. Profit before patient.

However I think that any Doctor not advising their patient of a drug that is best in class and or does not have the severe side effects, could be held to be negligent.

In this day and age the patient has a lot more information at their disposal through the Internet.

It only takes one person to realise that they have been shafted and not given the best treatment and all of a sudden you have "class action". A term that Lawyers love and big pharma fear.
