interesting, but I doubt they foresaw the FDA holdup. It seems like a prudent topic / clause to include for both parties given the FDA decision was close & not known. SPL probably wanted separate payment clauses to maximise payment and spread the risk as much as ITF.
SPL will get paid for prevention and treatment approvals separately, which is good to know in the current situation.
